1. Who we are

This website, solmetta.com (the "Site"), is operated by PWR BRANDS LLC, a Delaware limited liability company doing business as Solmetta ("Solmetta," "we," "us" or "our"), 16192 Coastal Hwy, Lewes, DE 19958, United States. By using the Site or buying from us, you agree to these Terms of Service ("Terms") and to the policies linked below. If you don't agree, please don't use the Site.

2. Eligibility

You must be at least 18 years old and located in the United States to place an order. We sell and ship only to the 48 contiguous U.S. states and Washington, D.C.

3. Dietary supplement disclaimer

These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

Content on the Site, in our emails and on our social media is for general information only and is not medical advice. Talk to your doctor or another qualified healthcare provider before starting any supplement, especially if you are pregnant, nursing, taking medication (including hormone therapy), or have a medical condition such as kidney disease. Use products only as directed on the label, and stop use and consult a professional if you experience any adverse reaction. Individual results vary. Keep out of reach of children.

4. Products and pricing

We try to describe products, ingredients and prices accurately, but errors can happen. We may correct errors, change prices, limit quantities, or refuse or cancel any order (for example, suspected fraud or a pricing error). If we cancel an order after you've been charged, we'll refund you in full. Product images are for illustration and packaging may vary.

5. Orders and payment

By placing an order, you confirm that the information you provide is accurate and that you're authorized to use the payment method. Payments are processed securely by Shopify and our payment providers; we do not store your full card number. Prices are in U.S. dollars, and applicable sales tax is added at checkout.

6. Subscriptions

If you choose a subscription, you authorize recurring charges as described at checkout and in our Subscription Cancellation Policy, until you cancel. You can pause, skip or cancel anytime from your account or by emailing hello@solmetta.com.

7. Shipping, returns and refunds

Shipping is governed by our Shipping Policy, and returns and refunds by our Refund Policy. Title and risk of loss pass to you when the package is delivered to the carrier, but we'll still help with lost or damaged packages as described in those policies.

8. Accounts

You're responsible for keeping your account login secure and for activity under your account. Let us know right away if you suspect unauthorized use.

9. Acceptable use

You agree not to misuse the Site, including by attempting to interfere with its operation, accessing it by automated means without permission, reselling our products without our written consent, or using it for any unlawful purpose.

10. Reviews and submissions

If you submit a review, comment or other content, you confirm it is truthful and your own, and you give us a non-exclusive, royalty-free license to use, reproduce and display it in connection with Solmetta. We may remove content at our discretion.

11. Intellectual property

The Solmetta name, logo, website design, text, images and other content are owned by or licensed to PWR BRANDS LLC and are protected by law. You may not use them without our written permission.

12. Third-party services

The Site runs on Shopify and uses other third-party services (such as payment processors and our U.S. fulfillment partner). We're not responsible for third-party websites or services we link to, which have their own terms.

13. Disclaimer of warranties

Except as expressly stated in these Terms and to the fullest extent permitted by law, the Site and our products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee any specific health, fitness or other result from using our products.

14. Limitation of liability

To the fullest extent permitted by law, PWR BRANDS LLC and its members, managers, employees, suppliers and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from your use of the Site or our products. Our total liability for any claim relating to the Site or our products will not exceed the amount you paid us for the product giving rise to the claim. Some states don't allow certain limitations, so some of these may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless PWR BRANDS LLC from claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or misuse of the Site or products.

16. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim in your home state. Before filing any claim, please contact us at hello@solmetta.com so we can try to resolve it informally.

17. Changes

We may update these Terms from time to time. Changes apply from the date posted on this page. Your continued use of the Site after changes are posted means you accept them.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver. These Terms and the policies referenced in them are the entire agreement between you and us about the Site.
